1. מי רשאי להשתמש

השירות מיועד לבני ובנות 18 ומעלה בלבד. בכניסה לצ'אט את/ה מאשר/ת שמלאו לך 18 שנים. אם יתברר שמשתמש/ת הוא/היא קטין/ה, הגישה תיחסם.

2. כללי התנהגות

אסור להטריד, לאיים, להשפיל או לפגוע באחרים.
אסור לפרסם תוכן לא חוקי, תוכן מיני שלא בהסכמה, תוכן הנוגע לקטינים, הסתה, גזענות או שנאה.
אסור לשלוח ספאם, פרסומות, קישורים מזיקים או להתחזות לאחרים (כולל לצוות האתר).
אסור לפרסם או לקדם עסקים, אתרים, ערוצים או קבוצות (למשל בטלגרם או בוואטסאפ).
אסור להשתמש בבוטים, בסקריפטים או בכלים אוטומטיים, לאסוף מידע מהצ'אט, לבדוק חולשות אבטחה, לנסות לפרוץ למערכת או לשבש את פעולתה.
אסור לעקוף חסימה, למשל בכינוי חדש או מכתובת IP אחרת.
אל תשתפו פרטים מזהים: שם מלא, טלפון, כתובת, סיסמאות או פרטי תשלום.

3. ניהול ופיקוח

אפשר לדווח על משתמש/ת או הודעה ולחסום משתמשים. הצוות רשאי לבדוק דיווחים, להסיר תוכן, להשתיק ולחסום גישה לפי מזהה הסשן או כתובת ה-IP, בכל עת ולפי שיקול דעתו. מסנן מילים אוטומטי מסתיר מילים פוגעניות, ויש הגבלת קצב נגד הצפה. דיווחים על חשד לקטין/ה, איומים או תוכן לא חוקי נבדקים לפני כל השאר. דיווחים על פגיעה בקטינים או על עבירות חמורות אחרות יועברו לרשויות האכיפה. בסכנה מיידית פנו למשטרה (100). פגיעה בילדים ברשת אפשר לדווח גם למוקד 105.

4. מה הכלים בצ'אט לא מבטיחים

מחיקה לשני הצדדים: אפשרית עד שעה מהשליחה. היא לא מוחקת עותק שהצד השני כבר שמר, העתיק או צילם.
תמונה לצפייה אחת: אי אפשר למנוע צילום מסך או צילום של המסך במכשיר אחר.
אישורי קריאה: מי ששלח/ה לך הודעה פרטית רואה מתי היא נמסרה, מתי נקראה ומתי פתחת תמונה.
חסימה: מסתירה ממך את ההודעות של המשתמש/ת בחדרים, ומונעת ממנו/ה לשלוח לך הודעות פרטיות ולהתקשר אליך. היא לא מונעת ממנו/ה לראות מה שכתבת בחדרים, ולא תמיד מונעת חזרה בכינוי אחר.

לכן מומלץ לא לשלוח תמונות או מידע רגיש לאנשים שאינך מכיר/ה.

5. פרטיות

איזה מידע אנחנו שומרים, למה, כמה זמן ולמי הוא עשוי לעבור, וכן הזכויות שלך, מפורטים במדיניות הפרטיות, שהיא חלק מהתנאים האלה.

6. התוכן שלך וקניין רוחני

מה שכתבת או העלית נשאר שלך. כששולחים תוכן, מרשים לנו להציג, להעביר ולשמור אותו רק במידה שנדרשת כדי להפעיל את השירות ולטפל בדיווחים, ולפרקי הזמן שמפורטים במדיניות הפרטיות.
את/ה מצהיר/ה שמותר לך לשלוח את מה שאת/ה שולח/ת, כולל הסכמה של כל מי שמופיע/ה בתמונה.
הקוד, העיצוב, השם והלוגו של סבבה צ'אט שייכים למפעיל השירות. הגופן Rubik משמש לפי רישיון SIL Open Font License.
אם תוכן בצ'אט מפר זכויות יוצרים שלך, אפשר לפנות לכתובת שבסעיף 9, עם תיאור היצירה והתוכן המפר. נבדוק את הפנייה ונסיר את התוכן לפי הצורך.

7. אחריות ושיפוי

התוכן בצ'אט נכתב על ידי המשתמשים, והאחריות עליו היא שלהם. השירות ניתן כמו שהוא (AS IS), בלי התחייבות לזמינות רציפה. ככל שהדין מאפשר זאת, אנחנו לא אחראים לנזק שנגרם משימוש בשירות או מתוכן שמשתמשים אחרים פרסמו. אם נודע לנו על תוכן פוגעני או לא חוקי, נבדוק אותו ונסיר אותו לפי הצורך.

אם הפרת את התנאים או את החוק, ובעקבות זה הוגשה נגדנו תביעה או דרישה, ככל שהדין מאפשר זאת תשפה/י אותנו על ההוצאות הסבירות שנגרמו לנו, כולל שכר טרחת עורך דין.

8. דין וסמכות שיפוט

על התנאים ועל השימוש בשירות חל הדין הישראלי, וסמכות השיפוט נתונה לבתי המשפט המוסמכים בישראל. אם ייקבע שסעיף מסוים בתנאים אינו תקף, שאר הסעיפים ימשיכו לחול.

9. שינויים ויצירת קשר

התנאים עשויים להתעדכן מעת לעת. תאריך העדכון האחרון מופיע בראש הדף, ועל שינוי מהותי נודיע באתר לפני שייכנס לתוקף.

1. Eligibility

The service is for people aged 18 and over only. By entering the chat you confirm that you are at least 18. Users found to be minors will be blocked.

2. Rules of conduct

No harassment, threats, humiliation or abuse of others.
No illegal content, non-consensual sexual content, content involving minors, incitement, racism or hate speech.
No spam, advertising, malicious links, or impersonation of others (including site staff).
No promoting businesses, websites, channels or groups (for example on Telegram or WhatsApp).
No bots, scripts or automated tools, no collecting data from the chat, no probing for security weaknesses, and no attempts to break into or disrupt the service.
No evading a ban, for example with a new nickname or another IP address.
Don't share identifying details: full name, phone, address, passwords or payment details.

3. Moderation

You can report users or messages and block users. Staff may review reports, remove content, mute users and block access by session ID or IP address, at any time and at their discretion. An automatic word filter masks offensive words, and rate limits prevent flooding. Reports of a suspected minor, threats or illegal content are reviewed before anything else. Reports of abuse of minors or other serious crimes are passed on to law enforcement. In immediate danger, call the police (100). Harm to children online can also be reported to the 105 hotline.

4. What chat features can't guarantee

Delete for both sides: works for up to one hour after sending. It doesn't remove a copy the other person already saved, copied or photographed.
View-once photos: screenshots, or photographing the screen with another device, can't be prevented.
Read receipts: whoever sends you a private message sees when it was delivered, when it was read and when you opened a photo.
Blocking: hides that user's room messages from you and stops them from sending you private messages or calling you. It doesn't stop them from seeing what you write in rooms, and it can't always stop them from coming back under another nickname.

So we recommend not sending photos or sensitive information to people you don't know.

5. Privacy

What data we keep, why, for how long and who may receive it, as well as your rights, are described in the Privacy Policy, which is part of these terms.

6. Your content & intellectual property

What you write or upload stays yours. By sending content you allow us to display, transmit and store it only as needed to run the service and handle reports, and only for the periods listed in the Privacy Policy.
You confirm that you have the right to send what you send, including the consent of anyone who appears in a photo.
The code, design, name and logo of Sababa Chat belong to the operator. The Rubik font is used under the SIL Open Font License.
If content in the chat infringes your copyright, contact us at the address in section 9 with a description of the work and of the infringing content. We will review the request and remove the content as needed.

7. Liability & indemnification

Chat content is written by users, who are responsible for it. The service is provided "as is", without any guarantee of availability. To the extent permitted by law, we are not liable for damages arising from use of the service or from content posted by other users. When we learn of harmful or illegal content, we review it and remove it as needed.

If you break these terms or the law and a claim or demand is made against us as a result, you will, to the extent permitted by law, reimburse our reasonable costs, including legal fees.

8. Governing law & jurisdiction

These terms and your use of the service are governed by Israeli law, and the competent courts in Israel have jurisdiction. If any provision of these terms is found invalid, the remaining provisions continue to apply.

9. Changes & contact

These terms may be updated from time to time. The date of the last update is shown at the top of this page, and we will announce material changes on the site before they take effect.
